HB 614 & SB 1588: What Your Texas Board Needs to Know

Two recent waves of Texas HOA reform changed what your minutes must capture:

  • SB 1588 (effective September 1, 2021): Added Property Code §209.0051, requiring open board meetings with notice mailed to each owner not later than the 10th day before the meeting. Minutes are part of the association record an owner may request to inspect.
  • HB 614 (effective January 1, 2024): Requires associations to adopt and publish an enforcement policy with fine categories, fine schedules, and hearing procedures. Any fine hearing or board decision belongs in the meeting record an owner can inspect.
  • Records inspection: Under §209.005, the association has 10 business days from a written request to send notice of inspection dates. Missing minutes or undocumented votes turn a routine request into a liability question.
  • Pre-2021 minute formats may already be non-compliant. Boards still using ad-hoc volunteer notes are exposed.

What Texas Law Requires in Meeting Minutes

Open Board Meetings

Regular and special board meetings must be open to members, with notice of date, time, place, and general subject mailed to each owner no later than the 10th day before the meeting.

Inspectable Meeting Records

Approved minutes are part of the association record. The board must make meeting records available to a member for inspection and copying on written request.

10 Business Days to Respond

After receiving a written records request, the association has 10 business days to send written notice of inspection dates and times.
