Florida HB 913: What Your Board Needs to Know

Signed by Governor DeSantis and effective July 1, 2025, House Bill 913 is the most significant overhaul of Florida's community association laws in years. Here's what it means for your minutes:

  • Digital posting required: Associations with 150+ units must post approved minutes on a secure website or app. By January 1, 2026, this drops to 25+ units.
  • Virtual meetings must be recorded: Audio and video recordings must be retained for at least 1 year.
  • Individual votes must be recorded: Each director's vote or abstention on every matter must appear in the minutes.
  • 7-year retention: HOA meeting minutes must be retained for at least 7 years under F.S. 720.303.

What Florida Law Requires in Meeting Minutes

Recorded Votes

Each director's vote or abstention on every matter must be individually recorded in the minutes.

Digital Accessibility

Approved minutes must be posted within 30 days on a secure website. Threshold drops to 25+ units on January 1, 2026.

10-Day Record Access

Associations must provide access to official records, including minutes, within 10 business days of an owner's request.

Penalties for Non-Compliance

Failure to provide records access within 10 business days can result in fines of up to $500/day, capped at $5,000.
