Washington SB 5129: What Your Board Needs to Know

Senate Bill 5129, effective January 1, 2026, is Washington's most significant HOA reform in years. Combined with WUCIOA (RCW 64.90), here's what it means for your meeting minutes:

  • 15-minute owner comment period: Every board meeting must include a dedicated period for owner comments. Minutes must document that this occurred.
  • Open meetings required: Board meetings must be open to all unit owners except for specific executive session purposes.
  • Enhanced record access: Associations must provide records within 10 business days of a written request. SB 5129 strengthens enforcement mechanisms.
  • Attorney General oversight: The state AG's office now has expanded authority to investigate HOA complaints, including record access violations.

What Washington Law Requires in Meeting Minutes

Owner Comment Period

Every board meeting must include a minimum 15-minute period for owner comments. Minutes must document this period and any topics raised.

Open Meeting Requirements

Board meetings must be open to all unit owners. Minutes must reflect proper notice was given and the meeting was conducted in open session.

Associations must make records available for inspection within 10 business days of an owner's written request.

Recorded Votes

All motions, seconds, and vote outcomes must be documented. Minutes should identify how each director voted on substantive matters.
